Cash Bail!
When an individual is arrested and given bail one can put up the entire dollar amount to secure the release of the inmate. Cash bail may be a good alternative for those individuals with smaller bail amounts.
Q. How does cash bail work?
A. A friend or family member must take the entire dollar amount of the bail to the local law enforcement agency where the inmate is being held or the money can be deposited with the court clerk where the inmate’s case is being heard. Once the defendant completes his or her case the money will be returned. You can expect that it will take up to 12 weeks for the return of the bail money and court fees will normally be deducted.
Q. Are there any downsides to cash bail?
A. Yes! It must be noted if the defendant fails to appear, for any reason, the bail money gets forfeited to the court.
Please Note:
When a bail bond gets forfeited the bail bonding company can file a motion with the court to have the bail bond reinstated, therefore there is no loss.
Also when you go with a bail bondsman the indemnitor (cosigner) has the right to have the bond revoked, if at any time they feel that things aren’t going the right way.
With a cash bond you don’t have the ability to revoke the bond yourself; if you do wish to revoke the bond it can only be done through the court.
If the defendant does fail to appear you can expect that bail bonding company will do everything in their power to locate the fugitive to relieve you of the liability.
Q. Does the jail or court accept personal checks?
A. Usually only certified funds or cash will be accepted, but there are some agency’s that will accept personal checks to certain dollar amount.
It should also be noted, when doing a cash bond any dollar amount $10,000.00 dollars or above will require additional paperwork for reporting to the Internal Revenue Service.
Yes the I.R.S. will be notified of all transactions $10,000.00 dollars and above.
