Here’s a breakdown of the bail bond process:

Posting Bail: The defendant or their family can pay the bail amount directly to the court. If they cannot afford the bail amount, they can seek the help of a bail bond agent.

Bail Bond Agent: A bail bond agent (or bail bondsman) is a licensed professional who provides the court with a bond, which is a promise to pay the full bail amount if the defendant fails to appear in court. The defendant or their family typically pays the bail bond agent a non-refundable fee, usually 10-15% of the total bail amount.

Release from Custody: Once the bail bond is posted, the defendant is released from custody with the agreement that they will attend all scheduled court dates.

Court Appearance: If the defendant appears in court as required, the bail bond is dissolved at the conclusion of the case, and any collateral (if any was put up) is returned. If the defendant fails to appear, the bail bond is forfeited, and the bail bond agent is responsible for paying the full bail amount to the court. The agent may then seek to recover the amount from the defendant or their co-signers.

Collateral: Sometimes, the bail bond agent may require collateral (such as property, cars, or other assets) in addition to the fee to secure the bond. This collateral can be used to cover the bond if the defendant fails to appear in court.
